1. Scope

These Terms of Service govern the use of Termvio by businesses (the "Business"). The provider is Reka Digital — Blendion Reka, Marktgasse 46, 4900 Langenthal, Switzerland ("Termvio"). Termvio is intended exclusively for businesses, not for consumers. People who book an appointment via a booking page are subject to the terms of the respective business.

2. Services

Termvio is web-based software that lets businesses manage online bookings, team calendars, customer data, notifications, payments and vouchers. The current feature set is described on termvio.com. Termvio continues to develop the service and may change features as long as its core purpose is preserved.

3. Pilot phase and conclusion of contract

Termvio is in a pilot phase. Registration is only possible with a personal invitation code. The contract is concluded when the Business completes the setup and accepts these Terms and the Data Processing Agreement (DPA). During the pilot phase, features may still contain errors; feedback from the Business helps improve the service.

4. Trial, prices and payment

New businesses can try Termvio free of charge for 30 days without providing payment details. After that, a monthly subscription applies at the prices shown on termvio.com/en/pricing at the time of subscribing: a base price per active location including one staff member, plus a price for each additional active staff member. Changes to locations or staff are charged pro rata. Billing is monthly in advance via Stripe. If Reka Digital is subject to VAT, statutory VAT is added. Individual agreements, for example free months during the pilot phase, take precedence.

5. Term, late payment and termination

The subscription runs monthly and can be cancelled at any time with effect from the end of the current billing month, in the customer portal or by email to info@termvio.com. If a payment is missed, a grace period of 7 days applies. After that, the account switches to read-only access: data remains visible and exportable, while new bookings and changes are blocked until payment. Appointments already booked and their reminders remain in place. Termvio may terminate the contract with 30 days' notice to the end of a month, and without notice for good cause.

6. Obligations of the Business

The Business:

  • keeps its access credentials secret and protects owner and administrator accounts with the required two-factor sign-in;
  • is responsible for its services, prices, texts, images, cancellation and deposit rules, and for complete and accurate information on its booking page;
  • meets its legal obligations towards its customers, in particular information, price display and data protection duties, and obtains any required consents;
  • does not misuse Termvio, in particular for spam, unlawful content or attacks on the service.

7. Customer payments

Online payments and deposits run through the Business's own Stripe account, for which the Business concludes its own agreement with Stripe. The money goes directly to the Business. Termvio charges no booking or transaction commission; Stripe's fees are governed by the agreement between the Business and Stripe. The Business is responsible for refunds, chargebacks and cancellation fees.

8. Data and data protection

Customer data belongs to the Business. Termvio processes it as a processor under the DPA, which forms part of these Terms. The Business can export its data at any time. After the contract ends, it can still export its data for 30 days; Termvio then deletes it unless a legal retention obligation applies. Encrypted backups expire within at most 6 months.

9. Availability and support

Termvio strives for uninterrupted operation but does not guarantee any specific availability during the pilot phase. The service may be briefly interrupted for maintenance and backups, usually at night. Support is available by email at info@termvio.com on working days.

10. Liability

Termvio is liable without limitation for intent and gross negligence. Liability for slight negligence is excluded to the extent permitted by law, in particular for lost profits, indirect damage and data loss that an export could have prevented. Otherwise, liability is limited to the fees paid by the Business in the last 12 months. Mandatory statutory liability remains reserved.

11. Changes to these Terms

Termvio may amend these Terms and will announce changes at least 30 days before they take effect by email or within the service. If the Business continues to use Termvio without objecting, the changes are deemed accepted. If it objects, it may terminate the contract effective on the date the changes take effect.

12. Final provisions

Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Langenthal, Switzerland. If any provision is invalid, the remaining provisions remain valid.
